Terms of Service
- § 1
Contracting party and scope
These Terms of Service ("Terms") govern the use of the Treuly service. The contracting party and provider is Printproof UG (haftungsbeschränkt), [ERSETZEN: Straße Hausnummer, PLZ Ort] ("Provider"). The service is offered under the "Treuly" brand.
- § 2
Target audience and B2B character
Treuly is offered exclusively to businesses within the meaning of § 14 BGB (operators of shops, cafés, bakeries, salons, etc.). By concluding a paid subscription, the customer confirms that they are acting in the exercise of their commercial or independent professional activity. Consumer rights under § 13 BGB do not apply to the contractual relationship.
- § 3
Contract and account
The contract is concluded when the customer registers an account. Use of Treuly on the Free plan is free of charge on a permanent basis. By creating an account, the customer confirms that they are acting for commercial purposes. The customer must keep their access credentials confidential and may only use Treuly within the limits of applicable law.
- § 4
Plans, free trial and automatic renewal
Treuly offers a free plan and the paid plans Pro and Business. Paid plans are purchased exclusively in the Treuly iOS app as a subscription via the Apple App Store. The prices displayed in the App Store at the time of purchase apply.
Payment, renewal and cancellation are handled under the terms of the Apple App Store (Apple Media Services). The subscription renews automatically at the chosen billing interval (monthly or yearly) until it is cancelled, with effect from the end of the current billing period, via the Apple account's subscription settings.
Any free trial is disclosed in the App Store before purchase; unless the subscription is cancelled before the trial ends, it automatically converts into a paid subscription.
- § 5
Term and cancellation
The subscription can be cancelled at any time via the Apple account's subscription settings (App Store → Subscriptions). The cancellation takes effect at the end of the current billing period; no reason needs to be given. The paid plan remains fully usable until the end of the period; thereafter the account is automatically moved to the Free plan. The user account itself can be deleted at any time in the logged-in area at https://www.treuly.de/en/account.
- § 6
Right of withdrawal
Treuly is offered exclusively to businesses within the meaning of § 14 BGB; no statutory right of withdrawal under §§ 312g, 355 BGB applies to businesses. For purchases via the Apple App Store, Apple's terms additionally apply.
- § 7
Refunds
Subscriptions are billed through the Apple App Store; refunds are governed by Apple's refund terms and can be requested directly from Apple (https://reportaproblem.apple.com). If you have questions, support@treuly.de is happy to help.
- § 8
Availability
Treuly is provided with reasonable industry-standard care. We aim for high availability but do not guarantee a specific service-level percentage unless expressly agreed in writing. Planned maintenance will be announced in advance where possible.
- § 9
Liability
The Provider is liable without limitation under statutory provisions in cases of intent and gross negligence and for injury to life, body, or health. For ordinary negligence, the Provider is liable only for the breach of material contractual obligations (cardinal duties) and limited to the contract-typical, foreseeable damage. Any further liability is excluded.
- § 10
Final provisions
These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Exclusive place of jurisdiction for any disputes arising from or in connection with these Terms is [ERSETZEN: Ort — Sitz der Printproof UG], Germany, provided that the customer is a merchant, a legal entity under public law, or a special fund under public law.
If individual provisions are or become invalid, the validity of the remaining provisions is not affected.
- § 11
Draft status
These Terms are a draft — legal review is pending.
